Terms of Service

1. VODsense

VODsense is a software tool designed to help gaming coaches organize and review gameplay VODs, create notes and timestamped moments, annotate supported video sources, and request gameplay links from clients.

Certain features depend on the type of video source being reviewed. External providers such as YouTube and Twitch may not support every feature available for local video files.

2. Accounts

You are responsible for:

• maintaining the security of your account
• providing accurate account information
• activity performed through your account
• protecting your login credentials

You may not intentionally access another user's account or attempt to bypass VODsense access controls.

3. Subscriptions

VODsense currently offers:

• Monthly: $3.99 per month
• Yearly: $39.99 per year

Eligible new coaches may receive one seven-day trial. A payment method may be required to begin the trial. Trial eligibility is determined by VODsense's server-side account records and is limited to one eligible trial per coach.

Unless canceled before the applicable renewal or trial conversion, subscriptions may renew and charge according to the selected plan. Current pricing and billing information shown at checkout controls if it differs from outdated promotional material. Applicable taxes or other legally required charges, if any, may be shown during checkout.

4. Cancellation

Subscriptions may be canceled through the available account or billing controls. Cancellation affects access according to the subscription status associated with the account.

Canceling a subscription does not automatically delete locally stored VODsense projects, notes, annotations, or other local project data.

5. Payments and Refund Questions

Payments are processed by Stripe. If you believe a payment was incorrect or unauthorized, contact:

Refunds are handled according to applicable law and any refund terms presented at the time of purchase. Nothing in these Terms limits consumer rights that cannot legally be waived.

6. Local Data

VODsense is local-first. Users are responsible for maintaining backups of important local projects and source video files. VODsense may preserve locally created application data when the program is uninstalled so that projects can remain available after reinstalling.

If a local source video is moved, deleted, damaged, or becomes unavailable, VODsense may no longer be able to play that video until the user restores or relinks it.

VODsense is not responsible for loss of files stored solely on a user's own device except where liability cannot legally be excluded.

7. External Services and Video Sources

VODsense may integrate with or link to external services such as:

• YouTube
• Twitch
• Google Drive
• Dropbox
• OneDrive

Those services are operated independently from VODsense. Availability, playback behavior, permissions, retention, restrictions, and other provider behavior may change without VODsense's control. Use of those services is also subject to the provider's own terms and policies.

8. Request VOD

Request VOD allows coaches to request an external gameplay/video link from a client. Clients do not need a VODsense account or subscription to use a valid Request VOD link. Request VOD is not a VODsense-hosted gameplay upload service.

Users must not use Request VOD to distribute illegal, malicious, infringing, or abusive content or links.

9. Acceptable Use

You may not use VODsense to:

• violate applicable law
• access accounts or data without authorization
• interfere with or disrupt VODsense infrastructure
• abuse public endpoints or automated systems
• distribute malicious content
• intentionally bypass subscription or access controls
• exploit VODsense to infringe the rights of others

You may not attempt to circumvent VODsense security or paid-access controls except where applicable law expressly grants a right that cannot be restricted.

10. Intellectual Property

VODsense software, branding, interface designs, and other VODsense-created materials are protected by applicable intellectual-property laws. These Terms grant you permission to use VODsense while you have lawful access to the service. They do not transfer ownership of VODsense intellectual property.

Users retain responsibility for and rights to their own gameplay videos, notes, projects, and other content, subject to any rights belonging to third parties.

11. Availability and Changes

VODsense may be updated, modified, or discontinued. Features dependent on third-party services may change because of changes made by those providers. We may perform maintenance or make changes necessary for security, reliability, compatibility, or product development.

12. Suspension or Termination

Access may be restricted or terminated where reasonably necessary because of:

• nonpayment
• abuse
• security concerns
• violation of these Terms
• legal requirements

Suspension of online access does not automatically authorize VODsense to delete locally stored user project data.

13. Disclaimer

To the maximum extent permitted by applicable law, VODsense is provided on an "as available" basis. We do not guarantee uninterrupted availability, compatibility with every third-party video source, or that every external link or provider will remain available.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, VODsense will not be liable for indirect, incidental, special, consequential, or similar damages resulting from use of or inability to use the service.

Where liability cannot legally be excluded, liability will be limited only to the extent permitted by applicable law. These limitations do not apply where prohibited by law.

15. Changes to These Terms

These Terms may be updated as VODsense evolves. Material changes will be reflected through an updated effective date or other appropriate notice where required. Continued use after updated Terms become effective constitutes acceptance where permitted by law.

16. Applicable Law

These Terms are subject to applicable law. Nothing in these Terms removes mandatory consumer rights or protections that apply to you. No specific jurisdiction or venue is stated here unless VODsense later publishes one.
